Description: On February 25th, the Attorney General, through the Division of Criminal Justice, issued an interim guidance on discovery and evidence in Alcotest 9510 cases.
The memo directs municipal prosecutors on what evidence to supply to the defense bar in a 9510 case, how to handle requests for data downloads, and what evidence to introduce at trial to satisfy the foundational requirements for the admissibility of breath test results from the 9510.
Of course, none of these directions is supported by published case law, leaving DWI defense attorneys with a wide array of options for mounting a zealous and effective defense in a DWI trial based upon 9510 evidence.
This minimum 1.5 credit CLE will explore in detail each of the discovery and trial evidence documents described in the DCJ memo and suggest how to meet the challenge of the purported evidence in municipal court both before and during a trial.
